Please read these Terms of Service ("Terms") carefully before using the ContentPeaks platform and services ("Service") operated by MB Devnexis ("we," "us," or "our"), a company registered in the Republic of Lithuania, with its registered address at Perkūnkiemio g. 19, LT-12120 Vilnius, Lithuania.
By registering for or using the Service, you ("User" or "you") agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, do not use the Service.
"Service" means the ContentPeaks web application and SaaS platform accessible at https://contentpeaks.com.
"Account" means the account you create to access and use the Service.
"Subscription" means a paid plan granting access to the Service for a defined billing period.
"Content" means any text, data, files, or materials you upload, submit, or generate through the Service.
"Intellectual Property Rights" means all patents, copyrights, trademarks, trade secrets, and other proprietary rights.
To use the Service, you must be at least 18 years of age and have the legal capacity to enter into a binding agreement. By creating an Account, you confirm that you meet these requirements.
When registering, you agree to:
Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password confidential and not share access with unauthorised parties
Notify us immediately at hello@contentpeaks.com if you suspect any unauthorised use of your Account
You are responsible for all activity that occurs under your Account. MB Devnexis is not liable for any loss or damage arising from your failure to maintain the security of your credentials.
ContentPeaks offers paid subscription plans on a monthly or annual basis. The features, limitations, and pricing of each plan are described on our pricing page at https://contentpeaks.com/pricing. We reserve the right to modify, add, or remove plans at any time with reasonable prior notice.
By subscribing, you authorise us to charge your payment method on a recurring basis (monthly or annually, depending on your chosen plan). All payments are processed securely through our payment processor, Stripe. Prices are displayed exclusive of VAT unless otherwise stated. Applicable taxes will be added at checkout in accordance with Lithuanian and EU tax law.
Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You will receive a reminder before annual renewals.
We may change subscription prices at any time. If we change the price of your current plan, we will notify you at least 30 days in advance by email. Price changes take effect at the start of your next billing period. If you do not agree to the new price, you may cancel your subscription before the change takes effect.
If a payment fails, we will attempt to retry the charge. If payment cannot be collected after reasonable attempts, we reserve the right to suspend or terminate your access to the Service until the outstanding balance is settled.
You may cancel your subscription at any time through your account settings or by contacting us at hello@contentpeaks.com. Upon cancellation, your subscription will remain active until the end of the current paid billing period, after which access to paid features will cease. You will not be charged for subsequent billing periods.
All payments for ContentPeaks subscriptions are non-refundable. As ContentPeaks is a digital SaaS service, access to the Service is provided immediately upon payment and the full value of the subscription is delivered from the moment of purchase. We do not offer partial refunds, prorated refunds, or credits for unused portions of a subscription period.
This policy applies to all subscription types, including monthly and annual plans, and applies whether you cancel mid-period or at the end of a billing cycle.
Notwithstanding the above, we will consider refund requests in exceptional circumstances (such as duplicate charges or technical failures on our end) on a case-by-case basis. To raise such a request, contact hello@contentpeaks.com within 14 days of the charge.
Note for EU consumers: If you are a consumer located in the European Union, you may have a statutory right of withdrawal within 14 days of purchase under applicable law. However, by subscribing to ContentPeaks, you expressly consent to immediate delivery of the digital service and acknowledge that you lose your right of withdrawal once performance begins.
You agree not to use the Service to:
Violate any applicable law or regulation
Infringe the intellectual property rights of others
Transmit malware, spam, or harmful code
Attempt unauthorised access to the Service or systems
Abuse API limits or scrape the Service without permission
We reserve the right to suspend or terminate accounts that violate this policy.
You retain ownership of Content you upload. By submitting Content to the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your Content solely for the purpose of providing the Service.
ContentPeaks generates content using AI models. You are responsible for reviewing and validating generated content before publishing. We make no guarantees as to the accuracy, completeness, or suitability of generated content.
We retain all rights, title, and interest in and to the Service, including software, branding, trademarks, and related IP.
The Service may integrate with third-party services (e.g., Google OAuth, Stripe, CMS platforms). Your use of such services is subject to their terms. We are not responsible for third-party services’ availability or actions.
We aim to provide reliable access to the Service but do not guarantee uninterrupted operation. Maintenance, updates, or outages may occur. Support is provided via hello@contentpeaks.com.
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, MB Devnexis shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or other intangible losses.
Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless MB Devnexis from any claims, damages, liabilities, and expenses arising from your use of the Service, your Content, or violation of these Terms.
We may suspend or terminate your access to the Service if you violate these Terms or applicable law. Upon termination, your right to use the Service ceases immediately.
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict of laws principles.
If a dispute arises, the parties agree to attempt good-faith negotiation. If the parties cannot reach a resolution within 30 days, the dispute shall be submitted to the exclusive jurisdiction of the courts of Vilnius, Lithuania.
If you are a consumer resident in the European Union, you may also use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr to resolve disputes.
We reserve the right to update or modify these Terms at any time. We will notify you of material changes by email or by posting a prominent notice on the Service at least 14 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.
Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MB Devnexis regarding your use of the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
Assignment: You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Notices: All notices to us should be sent to hello@contentpeaks.com. We may send notices to the email address associated with your Account.
